1. Do we have to hire lawyers and proceed through the courts to settle our divorce? You may be surprised to learn that you are not required to hire a lawyer to settle the terms of your divorce. In fact, the courts in Minnesota actually strongly encourage you to try divorce mediation before going through the litigation process. Mediation has many benefits: it is less expensive, takes less time and creates less conflict than a court battle.
2. What is a no-fault divorce? Minnesota is a no-fault state, meaning that you will be granted a divorce, no matter what the cause of your divorce is. So, you are not required to prove that your spouse did anything wrong, and he/she will not need to prove that about you. This can help move the process along more quickly.
3. How long does it take to complete the divorce process? One of the most common questions we are asked is how long my divorce will take. All divorces are unique, and we may not be able to give you a specific answer, but the team at Johnson Mediation can tell you that the average divorce using mediation takes 3-4 two hour sessions over the course of 2-4 months.
4. How much does a divorce cost? If you go through litigation, you can expect to spend anywhere from $10,000-$20,000. Mediation is far less expensive – between two and ten times less than a court battle.
